Terms of Service
Last updated: 19 October 2026
Using the service
PicWhim turns a photo you upload into a Halloween-style image. By using the site you agree to these terms. If you do not agree with them, please do not use the service.
Your photos and permission
Before you can generate anything you must confirm the statement "I own this photo or have permission from the people shown in it." That is a requirement, not a formality: do not upload a photo of someone who has not agreed to it.
You keep whatever rights you have in the photos you upload. You give us permission to process the photo, and to pass it to our AI provider, for the sole purpose of producing your result.
Prohibited uses
You may not use PicWhim to create or share any of the following. We may remove content and block access when these rules are broken:
- Anything unlawful, or anything that sexualises a minor in any way.
- Images that place a real person in a degrading, violent or harassing context.
- Fake or misleading images of a real person that could be taken as genuine.
- Photos of other people that you do not have permission to use.
- Attempts to get around the free allowance, the rate limits or the spend budget.
- Automated scraping, bulk generation, or reselling the service.
Storage is temporary
Generated images are not stored by us indefinitely. A free result is kept for about 7 days and a paid result for about 30 days, and the original photo you uploaded is deleted within about a day. A scheduled job removes each file automatically once its window has passed, and a deleted file cannot be recovered.
We make no promise that any image will still be available tomorrow. If you want to keep a result, download it before its window closes.
Payments
Generations are sold as one-off packs. A pack is a single purchase that adds a set number of generations to your account; it is not a subscription and it does not renew. Payment is handled by our payment provider, and we do not receive or store your card details.
Availability and changes
The service is provided as it is. It depends on third-party AI providers, so a generation can fail or take longer than usual, and we may change or withdraw features at any time.
We may update these terms; the date at the top of this page shows when they last changed. Continuing to use the service after a change means you accept the updated terms.
